Terms of Service
Last Updated: September 13, 2026
These Terms of Service (“Terms”) govern your use of the NovaVolt Systems website and services. By accessing our website or using our services, you agree to these Terms.
1. Our Services
NovaVolt Systems provides business communications services, including business phone systems, VoIP, unified communications, messaging, and related communication solutions.
Specific services, features, pricing, service levels, and other commercial terms may be described on our website or in the applicable customer order, service agreement, or other agreement with NovaVolt.
2. Acceptable Use
You agree to use NovaVolt services only for lawful purposes and in compliance with applicable laws and regulations.
You may not use our services for fraud, harassment, unlawful communications, unauthorized access, spam, malicious activity, illegal or unauthorized robocalling, or any activity that interferes with or damages our systems, networks, services, or other users.
3. Customer Responsibilities
Customers are responsible for providing accurate account and billing information, maintaining the security of their accounts and credentials, and ensuring that their use of NovaVolt services complies with applicable laws and regulations.
Customers are also responsible for maintaining suitable internet connectivity, electrical power, network equipment, and compatible devices required to use applicable services.
4. Service Availability
NovaVolt works to provide reliable communications services. However, telecommunications and internet-based services may occasionally experience interruptions, maintenance, network issues, power outages, internet outages, equipment failures, or circumstances outside NovaVolt’s reasonable control.
VoIP and other internet-based communications services depend on working electrical power, internet/network connectivity, compatible equipment, and properly configured services.
Any specific service-level commitments provided to a customer will be governed by the applicable customer agreement.
5. Emergency Calling and E911
Emergency calling through VoIP services may operate differently from traditional telephone service and may be unavailable or limited during power failures, internet or network outages, service interruptions, equipment failures, or other circumstances affecting the communications service.
Customers are responsible for providing and maintaining accurate physical or dispatchable location information for users and telephone numbers where emergency calling is available. Customers must promptly update this information when a user or device moves to a different location.
Customers with remote, mobile, or nomadic users should understand that emergency calls may be routed using the registered emergency location rather than the caller’s actual current location if the registered information has not been properly updated.
Customers are responsible for informing their users of applicable emergency-calling limitations and ensuring that required emergency-location information remains accurate.
Where required as part of service activation or configuration, customers may be required to acknowledge applicable E911 disclosures and emergency-calling limitations.
6. Special-Purpose and Safety Systems
Unless NovaVolt specifically confirms compatibility for a particular service or configuration, VoIP services should not be relied upon for alarm systems, elevator emergency phones, medical-alert systems, fire or security systems, or other safety-critical or special-purpose communications equipment.
Customers are responsible for confirming compatibility and maintaining appropriate alternative communications arrangements where necessary.
7. Telephone Numbers and Number Porting
Where available, customers may request new telephone numbers or transfer eligible existing numbers to NovaVolt.
Number porting is subject to carrier requirements, regulatory requirements, account verification, and number eligibility. Porting timelines may vary.
8. Messaging and Communications
Customers using calling, SMS, MMS, or other communications features are responsible for complying with applicable laws, regulations, consent requirements, industry rules, and acceptable-use requirements.
Customers are responsible for obtaining required permissions and consents for their communications and for complying with applicable messaging registration and carrier or industry requirements, including A2P/10DLC requirements where applicable.
Customers using call-recording features are responsible for complying with applicable recording, notification, and consent laws and requirements.
NovaVolt may restrict or suspend communications activity when reasonably necessary to prevent fraud, abuse, unlawful activity, security threats, or regulatory violations.
9. Fees and Billing
Pricing and applicable charges will be disclosed through NovaVolt’s website, order process, service agreement, or other applicable customer documentation.
Customers are responsible for charges associated with the services they order and use.
10. Third-Party Services
NovaVolt may use third-party telecommunications carriers, infrastructure providers, software platforms, and other service providers to deliver portions of its services.
NovaVolt may change underlying providers or technologies as necessary to operate, maintain, improve, or support its services.
11. Intellectual Property
The NovaVolt name, branding, website content, graphics, designs, and other materials owned by NovaVolt are protected by applicable intellectual-property laws.
Third-party trademarks and materials remain the property of their respective owners.
12. Privacy
Our collection and use of personal information are described in our Privacy Policy, which should be read together with these Terms.
13. Limitation of Liability
To the fullest extent permitted by applicable law, NovaVolt will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, our website or services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. Suspension or Termination
NovaVolt may suspend or terminate access to services where reasonably necessary because of nonpayment, unlawful or abusive activity, security risks, regulatory requirements, violation of these Terms, or violation of an applicable customer agreement.
Specific termination rights and procedures may also be established in the applicable customer agreement.
15. Changes to These Terms
We may update these Terms periodically to reflect changes to our services, business practices, technology, or legal requirements.
The “Last Updated” date will identify the most recent version.
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
